This Acceptable Use Policy ("AUP") defines the standards of behaviour expected from all users of the Vistofy Application, website, and associated services. This AUP is incorporated into and forms part of our Terms & Conditions.

1. PURPOSE

The purpose of this policy is to ensure that the Vistofy Platform is used responsibly, ethically, and legally by all users. Violations of this AUP may result in suspension or termination of your account and, where applicable, may be reported to the relevant legal authorities.

2. PERMITTED USES

The following are examples of permitted and encouraged uses of the Vistofy Platform:

Creating branded social media content, marketing materials, and business communication for your own registered business;
Using templates and design tools to produce professional-looking posts for platforms like Instagram, Facebook, WhatsApp, and others;
Sharing designs with customers, clients, and stakeholders in connection with your own business activities;
Using the platform's customer greeting and personalisation features for your genuine business customers.

3. PROHIBITED USES

3.1 Illegal Content

Do not use the Platform to create, store, share, or distribute content that is illegal under Indian law or the laws of your jurisdiction;
Do not create or distribute content that promotes, incites, or glorifies illegal activities, terrorism, or violence;
Do not use the Platform for any fraudulent purpose or to engage in financial scams.

3.2 Harmful & Offensive Content

Do not create or share content that is obscene, pornographic, or sexually explicit;
Do not create or share content that is defamatory, libellous, abusive, threatening, or harassing;
Do not create or share content that promotes hate, discrimination, or violence based on caste, religion, gender, race, nationality, disability, or sexual orientation;
Do not use the Platform to bully, harass, or intimidate any individual.

3.3 Intellectual Property Violations

Do not use copyrighted material (images, logos, text, music) in your content without proper authorization or license;
Do not create content that infringes or misappropriates any third-party trademark, patent, or other intellectual property right;
Do not use the Platform to create content impersonating any real individual, business, or brand.

3.4 Platform Abuse

Do not attempt to gain unauthorized access to any part of the Platform or another user's account;
Do not use automated scripts, bots, or tools to scrape data from or overload the Platform;
Do not attempt to circumvent any security measure or technical protection of the Platform;
Do not use the Platform for cryptocurrency mining, spamming, or phishing.

3.5 Commercial Misuse

Do not use a single Subscription to serve multiple businesses or clients without a Commercial License;
Do not resell, sublicense, or otherwise commercially exploit access to the Platform without written authorization from the Company;
Do not distribute unsolicited commercial communications (spam) using content created with the Platform.

4. CONTENT STANDARDS

All content created and shared using the Platform must:

Be truthful and not misleading to consumers;
Comply with the Consumer Protection Act, 2019 and Advertising Standards Council of India (ASCI) guidelines;
Not make false or unsubstantiated claims about products, services, or competitors;
Comply with all applicable laws and regulations in the territories where it is published.

5. CONSEQUENCES OF VIOLATION

Violation of this Acceptable Use Policy may result in one or more of the following actions at the Company's sole discretion:

Formal warning issued to the account holder;
Temporary suspension of access to the Platform;
Permanent termination of the user account without refund;
Removal of content that violates this AUP;
Reporting to law enforcement authorities or regulatory bodies where required by law or deemed appropriate;
Civil or legal action for damages caused by the violation.

6. REPORTING VIOLATIONS

If you become aware of any content or activity on the Platform that appears to violate this AUP, please report it to us immediately at: abuse@vistofy.in or support@vistofy.in. We will investigate all reports and take appropriate action.

7. UPDATES TO THIS POLICY

The Company reserves the right to update this AUP at any time. Continued use of the Platform after notification of changes constitutes acceptance of the updated policy.
